I accept these terms and wish to register.

1) Term of the Agreements: The term of this Agreement will begin upon our acceptance of your Affiliate application and will end when terminated by either party. We will not terminate this agreement without just cause. You are eligible to earn referral fees on sales occurring during the term.

2) Modification: We will not modify the terms of this Agreement without just cause. But if something that we had not foreseen comes up, we may make modifications by posting a change notice or a new agreement on this site. If any modification is unacceptable to you, you may terminate this agreement by written notification. Your continued participation in the program following our posting of a change notice or new agreement on our site will constitute binding acceptance of the change.

3) Limitation of Liability: We will not be liable for indirect, special or consequential damages, or any loss of revenue, profits or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total referral fees paid or payable to you under to this Agreement.

4) Independent Investigation: You acknowledge that you have read this agreement and agree to all its terms and conditions. You understand that we may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this agreement or operate web sites that are similar to or compete with your web site. You have independently evaluated the desirability of participating in the program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.

5) Confidentiality and Nondisclosure: As an affiliate you may gain access to information which is confidential business intelligence belonging to translatortips.com, amazing publications or Alex Eames. By signing up as an affiliate you are deemed to understand that under no circumstances is it permissible to divulge, distribute, or cause to be distributed or divulged any such information including, but not limited to:

• statistical performance data
• marketing strategy
• competitive intelligence

6) Branding Consistency: All banners and text supplied to you must be used exactly as given to you. They may not be modified in any way whatsoever without our express written approval (email is considered written approval in this case).
In cases where you wish to write your own material we reserve the right to give guidelines in the interests of maintaining a consistent brand image across the internet.
Unless you have a high volume site and need to access the graphics locally, all banners used must be accessed directly from the translatortips.com server in the correct way (according to the html code we provide for you) in order to effectively measure banner efficiency.

7) Qualifying purchases: Your first purchase from translatortips™ is disqualified from the program. Also, any special promotions that we may run from time to time are not eligible for commission.
Any commissions on products which are subsequently returned for refund will be nullified. All other sales qualify for commission.

8) Miscellaneous: This Agreement will be governed by the laws of England and Wales, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the courts located in the county of Oxfordshire, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

9) SPAM: SPAMMING or sending unsolicited commercial email is grounds for instant termination. If you spam in our name we will kick you out and you forfeit the rights to any pending commissions. We are doing this to protect the translatortips.com name and site.

10) Inactivity or low activity: By signing up you have stated that the pages where you will promote translatortips.com receive at least 500 unique visitors per month. Within a very short time we will know if that is true or not. It is our intention to have an elite band of high performing sites. Poor performers will be weeded out. Also, if you generate no clickthroughs within a 3 month period - you're history!
